TRAVEL CONDITIONS

In this document you will find the Travel Conditions of Sportsworld Nikita. This page contains important information about the booking process, your trip, the stay, discounts, insurance and the general travel conditions of Tennis Academy Nikita. The websites sportsworldnikita.com and tennisreisspanje.nl are the property of the Tennis Academy Nikita and these terms and conditions therefore apply to both websites. We urge you to read the terms and conditions carefully before concluding a trip, so that you know what your rights and obligations are.

DEFINITIONS
Travel organizer: Tennis Academy Nikita which, in the course of its business, offers pre-arranged trips in its own name to the public or to a group of people.
Travel agreement: agreement to provide an organized trip with overnight or of more than 24 hours and a minimum of two of the following services:
transport;
residence;
other significant tourist service.
Group booking:
a. simultaneous registration of several persons by one applicant.
b. the applicant is liable for the obligations of the persons registered by him, also in the event of cancellation and payment.
c. the applicant is hereinafter referred to as “Traveller”
Traveler:
a. the other party of the Travel Organiser;
b. the person for whose benefit the trip has been stipulated and who has accepted that stipulation; c. the person to whom the legal relationship with the Travel Organizer has been transferred.

PREFERENCES AND WISHES
We do our best to meet preferences and wishes that are made known at the time of booking. We depend on the possibilities of third parties, such as the hotel or the airline. A preference can therefore never be a guarantee.

BOOKING/CHANGE FEES
To keep our prices as low as possible, we do not charge administration costs per person, but per invoice. So you pay € 15,– administration / booking costs, regardless of the number of people. If, at your request, changes have to be made to a booking that has already been made, a change fee of € 25 per incident may be charged. The change costs are in addition to any other travel and accommodation costs related to the change.

TRAVEL AND CANCELLATION INSURANCE
We would like to point out the importance of good travel and cancellation insurance. Taking out such insurance ensures that you do not have to worry financially in the event of illness and/or calamities. There are various organizations where you can insure yourself against this. For more information, see e.g. the websites of europeansche.nl or anwb.nl. Despite the fact that tennis and padel are covered as standard by most travel insurance policies, we would like to ask you emphatically whether this is also included in your (continuous) travel insurance.

TRAVEL BY PLANE
If you opt for one of our package holidays including air travel, the planned operating airline is stated with reservation. No rights can be derived. You can request your travel schedule from 14 days before your departure. However, this itinerary is always subject to change, as these times may change. You will find the final local flight times in your travel documents, but even then these are still subject to change. As a result, you may not receive the (digital) tickets until a few days before your departure. For example, due to technical / organizational reasons and / or weather conditions, changes can be made up to and including the day of departure from the Netherlands or on the return flight from Spain, with regard to, for example, airline, type of aircraft and / or flight schedule. Unfortunately, the Travel Organizer has no influence on this and cannot be held liable for this. We do make every effort to inform you about these matters as soon as possible. However, we recommend that you check the departure time of your flight on the website of the relevant airport before you go to the airport. Furthermore, in occasional cases you may have a late outward flight and an early return flight. On the outward journey, in the most unfavorable case, this would mean arriving at your accommodation even after midnight. On the return journey you may be picked up at the hotel very early in the morning.

HAND AND CHECKED LUGGAGE
Our offer includes hand and hold luggage. A racket may not be transported as hand luggage in an airplane. The quotation states the final maximum weights of the cases. We would like to point out that exceeding the weights can lead to additional payment at the airport.

A LA CARTE FLIGHTS
You fly to Spain à la carte. This means that during the flight snacks and drinks are not included in the travel sum, but are only available for an additional fee. AIRPORT TAXES AND SURCHARGES All (airport) taxes are included in the price of our trips (unless stated otherwise in the surcharges of the relevant trip). The security surcharge and the Airport Security Charge are also included in the travel sum of all our (air) trips.

TRAVEL DURATION
When, for trips that include transport, the duration of the trip and/or stay is stated in days, the days of departure and arrival are counted as whole days. This is regardless of the departure and arrival time. It may happen that the actual stay is less counts days than stated in the flyer and/or website. You cannot claim a refund of (part of) the travel sum if you leave late and return early. This also applies if your flight time changes after receipt of the travel documents. The all inclusive and the full board plus formulas start from the moment of arrival at the hotel and end at 12:00 (PM) on the day of departure. If you arrive at the hotel later due to a delay, or if you leave your hotel by transfer before 12 noon on the day of departure due to flight times, no refund is possible for any ‘missed’ meals and drinks. If you depart after 12:00 PM, you can usually also use the all inclusive or full board plus formula for the rest of the day against payment of a surcharge. If you stay on a half board basis, it may also happen that you miss a meal in case of late arrival or early departure. There is no refund for this. If possible, the hotel will offer a cold dish instead of dinner or you can order a breakfast package the day before departure.

EXTEND
Depending on the chosen travel period, it is often possible to extend your stay by one or more days. For this we can offer you a quote on site, with a complete tennis or padel program.

RESIDENCE
The package is based on a stay with two paying travelers in one double room. Depending on availability, it is also possible to book a triple room. SINGLE ROOM If you only go on a tennis or padel holiday, you can choose to stay in a single room or a double room for single use. There is always a surcharge for this. In the case of a single room, you almost always pay a surcharge. The number of single rooms is limited and the supplements for single rooms are relatively high. However, we do everything we can to keep the surcharges as low as possible. It is important for you to know that in several hotels it is possible to book a double room for single use, but here too a surcharge applies. You can email us for more information about the single rooms in your chosen hotel.

THE UPGRADE OF ROOMS
In accordance with our travel conditions, you should get the room you booked for. If this is not possible due to unforeseen circumstances, you should be allocated accommodation of equivalent or better quality. Sometimes, once on site, it turns out that only luxury rooms are available. As a result, you or other participants may be placed in a more luxurious room than the one booked and paid for. It also happens that the hotel decides as an extra service to allocate all participants of the tennis and padel trip in more luxurious rooms, despite the fact that the booked rooms are still available. The hotel always determines the layout of the rooms itself. The Travel Organizer has no influence on this. We are also not informed of this in advance.

SEASONAL INFLUENCES
In the early or late season the occupancy of the hotel is lower. It is therefore possible (or due to weather conditions) that certain parts of the hotel program will not take place or that some facilities will be closed or have limited opening hours. For example, an à la carte restaurant, swimming pool, water sports facilities and an entertainment programme. It is also possible that meals are served in menu form instead of buffet style. The Travel Organizer cannot be held responsible for these ‘seasonal influences’.

DISCOUNT ‘NO PARTICIPATION TENNIS PROGRAM’
The prices in our flyer and on our website are all-in prices unless stated otherwise, i.e. including the tennis and/or padel programme. If you or your travel companion would like to participate without a tennis program, we can make you an interesting offer.

TENNIS CLASS
The tennis lessons are given on clay courts with a maximum of 4 people on one court. Your tennis coach has years of experience in competitive sports and teaching and is in possession of a KNLTB A+B license or equivalent. The time of the lesson will take place as much as possible at the time you want. Despite the fact that the tennis park has a large number of courts, there is a chance that occupation is such that this is not possible. The lessons take place for 2 consecutive hours with a 5 minute break every hour, whereby the teacher does not necessarily have to be on the track.

PADEL LESSONS
The padel lessons are in principle given on artificial grass courts with 4 people on one court. Your padel instructor is professional and has years of competition experience in Spanish padel sport and teaching, in addition, your trainer has a KNLTB A + B license or equivalent. The time of the lesson will take place as much as possible at the time you want. Despite the fact that the park has a large number of padel courts, there is a chance that occupation is such that this is not possible. The lessons take place for 2 consecutive hours with a 5 minute break every hour, whereby the teacher does not necessarily have to be on the track.

DISCOUNTS AND OFFERS
Possible discounts and offers are only valid for the mentioned room types departure dates. Mentioned prices are from prices p.p. and for a double occupancy of a double room with Bed and Breakfast. When you book, the discount is automatically deducted from the invoice you receive from us. Discounted trips may be sold out on certain dates. If an extra trip is added to the offer, the discount on the extra trip does not apply. Discounts do not apply to bookings already made. Discounts also do not apply to changes to bookings already made. Discounts are not given on the separate sale of options and extras, airline tickets, bus transfers and insurance. Price changes and typing errors reserved.

TRAVEL CONDITIONS

1. RIGHT OF WITHDRAWAL
The Traveler has the right to withdraw from the travel agreement free of charge within 24 hours after the conclusion of the travel agreement without giving reasons, unless this right is excluded in the offer by the use of the term “definitive booking”. In this context, Traveler is exclusively understood to mean the main booker/applicant. The Traveler has no right of withdrawal if the travel agreement is concluded within 56 days before departure or if it concerns a trip on request and out of stock.
2. DEPOSIT
2.1. The deposit, of 1/3 of the total travel sum, must be paid within 48 hours after you have received our invoice. Non-direct down payment can lead to higher costs. The remaining amount must be in our possession no later than 42 days before departure. When you book within 42 days before departure, the deposit is the total travel sum. You can pay your invoice by means of a transfer to our account number, stating your invoice number.
2.2. If you have not made full payment seven (7) days before departure, we will not send you the travel documents. As soon as the payment has been received, we will send your travel documents. 2.3. The Traveler who has not paid on time owes statutory interest on the amount due from the date of default. Furthermore, after a reminder, he is obliged to reimburse the statutory (extrajudicial) collection costs as referred to in paragraph 2.4.
2.4. The legal (extrajudicial) costs are: 15% on a travel sum up to € 2,500, with a minimum of € 40.; 10% on the subsequent € 2,500; 5% on the next € 5,000 and 1% over the excess. The Travel Organizer may deviate from the stated amounts and percentages to the benefit of the Traveller.
3. CANCELLATION
3.1. Standard cancellation fees Tennisacademy Nikita.
If an agreement is canceled by the Traveler, the Travel Organizer can charge the Traveler the following cancellation costs:
– in case of cancellation up to the 42nd day before the day of departure: the payment;
– in case of cancellation from the 42nd day to the 28th day before the day of departure: 40% of the travel sum;
– in case of cancellation from the 28th day to the 21st day before the day of departure: 45% of the travel sum;
– in case of cancellation from the 21st day to the 14th day before the day of departure: 50% of the travel sum;
– in case of cancellation from the 14th day to the 5th day before the day of departure: 75% of the travel sum;
– in case of cancellation from the 5th day to the day of departure: 90% of the travel sum;
– in case of cancellation on the day of departure or later: the full travel sum.
3.2. Part cancellation
3.2.1. If a traveler from a travel group cancels his share in the agreement for a joint stay in a hotel, apartment, holiday home or other accommodation, he will owe cancellation costs.
3.2.2. If the size of the remaining group appears in the price table for this accommodation, the tour operator will make a change proposal to the remaining traveller(s) that is appropriate for the new group size for the same period and in the same or comparable accommodation.
3.2.3. If the change offer is not possible or is not accepted, the agreement will be canceled for all travelers and all travelers will owe a cancellation fee.
3.2.4. The total amount of cancellation money and changed travel sum will never exceed the total travel sum of the original travelers. Any surplus will be deducted from the new travel sum.
3.3 Cancellation outside office hours
Cancellations outside office hours are deemed to have been made on the next working day. The office hours of the Travel Organizer are: Monday to Friday from 08:00 AM – 06:00 PM.
3.4 Substitution
3.4.1. The Traveler can request the Travel Organizer to have himself or a group member replaced by another participant. The following conditions apply to this: the other participant meets all conditions attached to the agreement; and the request is submitted no later than 7 days before departure, or in such a timely manner that the necessary actions and formalities can still be performed; and the conditions of the service providers involved in the performance do not preclude this Substitution; and the Traveler or group member has not yet checked in with the airline. If the request cannot be granted, the Travel Organizer will inform the Traveler by email, stating reasons. 3.4.2. The Traveler and the person who replaces him or the group member are jointly and severally liable towards the Travel Organizer for the payment of the part of the travel sum still due, the change costs and any additional costs as a result of the replacement.
3.5 Extraordinary Circumstances
3.5.1. In the event of a natural disaster or serious safety problems at your holiday destination, which have consequences for your package trip, the Travel Organizer may cancel the package trip. You may also cancel your package holiday free of charge in such circumstances. If the Travel Organizer cancels, you are entitled to a full refund of all amounts paid, but you cannot claim any compensation. In case the Traveler cancels, a refund of a maximum of 2/3 travel sum will be made by the Travel Organizer. This cancellation can only apply if a calamity, such as a natural disaster or a serious safety problem, has been set as such by the local authorities and the trip cannot take place as a result.

4. TRAVEL DOCUMENTS
4.1. The Travel Organizer indicates in the travel confirmation to the Traveler at what time and in what manner it will make the travel documents available to the Traveller.
4.2. If the Traveler has not received any travel documents at the time communicated by the Travel Organiser, but no later than 5 working days before departure, he/she will immediately report this to the Travel Organiser.

5. OBLIGATIONS OF THE TRAVELER
5.1. The Traveler is obliged to comply with all instructions given by or on behalf of the Travel Organizer and is liable for damage caused by his actions. To judge this by the standard of the behavior of a correct traveller.
5.2. The Traveler who causes or can cause such nuisance or nuisance that the proper execution of the trip is or can be made more difficult as a result, can be excluded from (continuation of) the trip by the Travel Organizer if the Travel Organizer cannot reasonably do so. are required to comply with the agreement. The resulting costs will be borne by the Traveller. In such a case, the Traveler is not entitled to any refund.
5.3. The traveler is obliged to avoid any damage and to limit it as much as possible.
5.4. Every traveler must make sure of the exact time of departure no later than 24 hours before the indicated time of departure for the return journey.

6. Traveller’s age
6.1. In the case of a group booking, the Traveler (applicant) must be at least 18 years old.
6.2. The airlines have the obligation that Travelers under the age of 16 travel accompanied by someone over the age of 18.

7. TRAVEL ORGANIZER’S LIABILITY
7.1. The liability for damage suffered by the Traveler is limited to three times the travel sum, unless the Travel Organizer provides the service itself and/or in the event of intent or deliberate recklessness on the part of the Travel Organiser. The Travel Organizer cannot exclude or limit its liability for damage caused by the death or injury of the Traveller.
7.2. A shortcoming in the fulfillment of an obligation that can be attributed to him, also obliges the Travel Organizer to compensate for a disadvantage other than financial loss, insofar as this shortcoming has caused loss of travel enjoyment. This compensation amounts to a maximum of one time the travel sum.
7.3. If a treaty or a Regulation of the EU applies to a service included in the travel agreement, the Travel Organizer can invoke an exclusion or limitation of liability that that treaty or Regulation grants or allows to a service provider as such.
7.4. The Travel Organizer is also not liable if and insofar as the Traveler can or has been able to recover his damage under an insurance policy he has taken out, such as a travel and/or cancellation insurance.

WARRANTY SCHEME STO-Garant
Tennisacademy Nikita is affiliated with the STO-Garant Guarantee Fund for your guarantee scheme. This means that your payment is secured in the event of a possible bankruptcy, moratorium, etc. of the Travel Organiser. You do not pay your invoice directly to the Travel Organizer but deposit the money into a so-called third-party account. This money is only paid to the Travel Organizer on the day after your trip has ended. With your payment you will receive login details for the third-party account and both the Travel Organizer and you can view the payment details. For more information, we would like to refer you to the STO-Garant.nl site, where you can also check whether the Travel Organizer is actually connected.

PASSPORT AND VALIDITY
In accordance with our travel conditions, you must check before departure what requirements the country of destination sets with regard to your proof of identity. For the most up-to-date information, please contact the embassy of your holiday country. Do you not own the Dutch nationality, it is possible that other conditions apply to you. We advise you to contact the embassy of your holiday country about this.

HEALTH AND INJURIES
If the Traveler or one of the group members has health restrictions, we would like to know this in advance so that we can make the correct group classification. At the intake or start of a training, this can be indicated again to the tennis or padel instructor. The Travel Organizer cannot be held liable for any injuries sustained during the trip.

LESS PARTICIPANTS
The minimum number of participants that we use for a group trip is: for both the tennis and padel trip: 4 people.
Incidentally, it may happen that too few participants have registered in a certain period. In such a case, the Travel Organizer has the right to adjust the program and the number of teaching hours as follows:
1 participant = 5×1 hour private lesson instead of 5×2 hour group lesson with 4 people
2 participants = 5×1 hour group lesson with 2 people on one court instead of 5×2 hours with 4 people

CANCELING LESSONS
Due to weather conditions, it is possible that during the lesson the courts become unplayable due to rain. Because such situations can endanger the Traveller, the teacher is authorized to break off the lesson at that time. If more than 60 minutes of lessons have been taught, the lesson is considered to have been taught in its entirety. With less than 60 minutes, 1 hour is considered to have been taught and the Tour Organizer will make a maximum effort to make up the remaining hour at another time. This may imply that on other days more teaching hours are made or that a different surface (hard court) is played. However, the Travel Organizer cannot be held liable for hours not played. The weather conditions are regarded as force majeure and therefore no refund of monies is possible.

CANCELLED LESSONS
Due to weather conditions, the courses may be unplayable. At that time, the Travel Organizer will make every effort to make up for the canceled lessons at another time. This may imply that on other days more teaching hours are made or that a different surface (hard court) is played. However, the Travel Organizer cannot be held liable for hours not played. The weather conditions are regarded as force majeure and there is therefore no refund of monies.

COMPLAINTS
It goes without saying that we do everything we can to make your trip and stay as pleasant as possible. However, it may occasionally happen that we do not fully succeed due to unforeseen circumstances. If you have complaints, please submit them immediately to the tennis or padel instructor or at the reception of the hotel. At that moment something can often be done about it immediately, afterwards that is difficult. If the complaint is not resolved to your satisfaction, please contact Tennisacademy Nikita (+34 650830270) immediately. A complaint must be submitted to us by email info@sportsworldnikita.com no later than 2 months after the start of the trip.
